WEBINAR:  The Dreaded DOT Safety Concern Letter:  Five Steps for Making a Legally Defensible Fitness for Duty Determination

DOT's new drug and alcohol testing regulations, which became effective January 1, 2018, included expanded opioid testing and a revised significant safety concern procedure under 49 CFR part 40.135. Dealing with the significant safety concern letter issued by the MRO to the DER is leaving MROs, TPAs, employers, and medical examiners confused and concerned. Participate in a 60-minute webinar with management labor and drug testing attorney Tommy Eden, of Constangy, Brooks, Smith & Prophete, LLP, and Jeff Sims, owner of a’TEST Consultants, Inc., and walk away with a well-thought-out five-step plan for making a legally defensible fitness for duty determination.

Tommy Eden’s law practice is principally in the areas of Management Labor and Employment Law; Drug Testing Law (DOT Regulated and Non-Regulated) throughout the United States; defense of employers in federal court in all aspects of employment litigation including claims under Title VII, ADA, FMLA, FLSA, ADEA, and retaliatory discharge actions; defense of employers in charges brought with the EEOC, Wage and Hour Division, National Labor Relations Board, and the Department of Labor; and litigation over employee benefits under ERISA.  He also counsels employers on Immigration compliance under the Alabama Immigration Act and conducting I-9 audits under the Federal Immigration Act.

Jeff Sims is the President of a’TEST Consultants, Inc., a nationally recognized drug testing corporation since 1992, and a lifetime member of the Substance Abuse Program Administrators Association.  He is actively involved in new business development, volunteer public speaking, and is an author of several training courses used by his industry.
